An NTT was denied promotion by the Provost despite positive recommendations at every other level (chair, DPC, CPC, and Dean). The Grievance Committee examined the basis for the denial and assessed that, while the Provost had a contractual right to take such a personnel action, the denial in this case was so unusual that other factors other than performance likely served as the basis for the personnel action (for example, prior to this denial only 1 such denial had occurred in the last 5 years). In consultation with the MTA, the FSU decided that an unfair labor practice charge with the Department of Labor Relations (DLR) was warranted. A charge was filed on 1/10/25. A mediation effort between the FSU and UMB Administration occurred at the DLR. A settlement agreement was reached whereby the member would undergo an expedited promotion review.
